Any person violating this chapter shall be assessed by the City a penalty of $25.00 for each acre burned contrary to the restrictions of this chapter or planted contrary to the restrictions of this chapter. Upon notice being given by the City as to said penalty, the same shall constitute a lien against real property which was used for this burning or planting and the City may collect that penalty either by foreclosure upon real property according to statutes or by other civil remedies. The penalty shall be imposed against the owner of real property and against any lessee. All offences for violations of this chapter, where prosecution is necessary, shall be prosecuted in the District Court for Linn County. (Ord. 45 § 6, passed 10-8-1985; Code 2014 § 90.99)
