(1) In the event that any part of the work of the improvement is to be done under contract bids, then the Council shall direct the City Clerk and Recorder to advertise for bids for construction of that part of the improvement after having determined the time and manner of advertisement for bids, on the basis of the Council-approved report.

(2) The contracts may be let to the responsible bidder whose bid is in the best interest of the City as determined in the sole discretion of the Council. Council shall have the right to reject any or all bids when they are deemed unreasonable or unsatisfactory in the Council’s discretion.

(3) The Council shall require bonding of all contractors for the faithful performance of any contract let under the Council’s authority and the provisions thereof in case of default shall be enforced by action in the name of the City.

(4) If the Council finds, upon opening bids for the work of such improvement, that the bid in the best interest of the City is substantially in excess of the estimate, it may, in its discretion, provide for holding a special hearing on objections to the City proceeding with the improvement on the basis of such bid.

(5) Council may direct the City Recorder to publish one notice in a newspaper of general circulation in the City for said special hearing not to be held sooner than 10 days after the first publication of said notice. (Ord. 22 § 5, passed 12-14-1976; Code 2014 § 34.20)
